Payroll. Taxes. Human resources. Paperwork. Is this sounding more and more like a lovely list of your least favorite business functions?
Here’s another one: Labor law posters. These are one of the many compliance requirements your business must uphold to make sure you stay in business.
Labor law posters are mandatory for all employers in order to stay compliant with labor laws as well as to inform employees of their labor and employment rights. Companies that are found to be out of compliance with these labor laws may face fines anywhere from $100 to $10,000 or citations during an inspection. Note that these posters must be displayed in a conspicuous place where your employees can see them.
Here’s a quick rundown of the types of posters you need:
Occupational Safety and Health Administration (OSHA)
The basics: Lists both employee and employer rights regarding workplace safety. The poster also states that a worker has a right to a hazard-free workplace.
Fair Labor Standards Act (FLSA)
The basics: Displays minimum wage standards, overtime pay and child labor standards under the FLSA.
Uniformed Services Employment and Reemployment Rights Act (USERRA)
The basics: This act protects all ‘uniform’ employees from discrimination based on their service and also given certain rights the employer may not violate.
Equal Employment Opportunity (EEO)
The basics: This poster describes federal laws that prohibit job discrimination based on things like: race, color, sex, national origin, age, religion, equal pay, disability or genetic information.
Family and Medical Leave Act (FMLA)
The basics: Displays the rights employees have to take job-protected leave for qualifying events and explains the provisions of the FMLA.
Employee Polygraph Protection Act (EPPA)
The basics: Employees have the right to not be subjected to lie detector tests regarding employment opportunities (with certain exceptions).
The tricky part about these labor law posters is that they’re constantly being updated. You may be thinking:
Do I have to update my Labor Law posters every year?
…possibly. Whenever there are federal, state or OSHA changes, it’s mandatory that you update your poster to reflect the change. The frequency of these updates, however, varies by state and oftentimes state and federal agencies may change the laws without notifying individual businesses.
You may think that just buying a new poster every year will guarantee you’re up-to-date, but that’s not necessarily true. Not every change occurs on January 1st of the new year and government agencies may issue postings later than their laws’ effective dates.
So then how do I stay compliant?
The easiest way to make sure your business stays compliant is to sign up for a program that will automatically send you updated labor law posters when necessary. That way, the only thing that’s in your hands is replacing the old poster and hanging up the new one when it arrives.
